Partner, Head of Litigation & Dispute Resolution
Marcus Whitfield qualified in 2008 and joined Arist in 2012 to build its litigation practice, which now runs on two connected strands. The first is defamation and malicious falsehood, acting for individuals and businesses whose reputation has been damaged by false statements, including one recent matter securing a correction and damages for a tradesman defamed in a competitor's online posts.
The second is commercial damages litigation: businesses suing suppliers, competitors or former business partners for breach of contract, negligence or financial loss, and defending clients facing similar claims. A typical instruction might involve a manufacturer pursuing a supplier for consistently late deliveries that caused a client to lose a downstream contract.
Marcus deliberately keeps his caseload smaller than a volume litigation practice would, preferring a small number of matters run personally through to trial or settlement over a high-turnover model. He has represented clients against considerably larger opponents, and the firm counts a small number of reported wins among its litigation work rather than measuring success by case volume. He trained in London before returning to the North West in 2011.
